Abstract


School Physical Education is an important part of training overall developed talents to meet the needs of the country, which plays a key role for improving the national quality. With the constant perfection of College Physical Education Reformation, P.E. teaching becomes more and more abundant. There are more and more students participating in sports and other types of exercises, more and more injuries during sports exercises happen. Because of the frequent injuries, some universities cancelled some P.E. teaching contents with higher risk and severely restricted students’sports activities in school. This way is to stop eating for fear of choking, which severely influences the development of P.E. teaching activities and is unfavorable to quality cultivation of students. The author with your own intentions college physical education teaching experience, the literature material law, case analysis and comparative analysis of college sports injury accident, and put forward the constructive opinions can part with criticism or post for.The study mainly research legal basis, legal responsibility subject, the rules, principle, economic compensation of university students’sports injuring accident. Research conclusions are as follows:Deal with university students’sports injuring accident have rules to follow. We can draw on the experience of Japan’s educational legislation to formulate Dealing Method of Students Injuring Accident and distinguish whether the target adults to standardize responsibility division of various kinds of students’sports injuring accident in the special chapter.University students’sports injuring accident should, in liability principle, be on a fault liability. Under special circumstances, presumption of fault is applied in university students’sports injuring accident. The application of equitable responsibility is limited. We should be establish school P.E. responsibility insurance in our country to transfer risks, making the liability for damages of sports injuring socialized and market zed. Meanwhile, we should enhance propaganda of P.E. insurance, raise the consciousness of schools, students and parents, innovate in P.E. insurance products and improve school P.E. insurance system.University students’sports injuring accident can prevent and reduce, therefore, we should enhance the management of sports facilities, reinforce the education of security, standardize sports activities and construct health care system of preventing sports injuring incidents in universities
