Abstract


"Three old" reform was not a "name change of land" (by the collective variable state), "Account color" (farmers to home) as simple as that which interests of all parties involved in the game and the competition fierce and cruel anomaly. Transformation process, but also of collective land, house demolition compensation standards, and procedures for handling compensation disputes, collective assets of the reasonable quantitative, village-level restructuring of the company’s survival and development of measures to implement the social security benefits the villagers, the government’s persuasion, management and public interest regulation, links and cumbersome procedures, is very complex. More involved in the process of transforming real estate investment companies, government, village committee, village interests of the game and co-ordination, is a matter of land property rights system, investment and financing system, the social security system and so many residents of disputes, winding, to be put into practice to rationalize problems combined.But this paper on the "three old" transformation process involved in the practice of the legal relationship with the theoretical analysis of legal issues, proposed the "three old" rose to the legal system reform policy ideas.This paper is divided into six chapters, Chapter 1 Introduction, the study proposed the origins and significance of the study. Chapter II, "three old" transformation of the basic content, starting from the theoretical analysis of the concept of "three old" transformation of the basic situation. Chapter III "three old" transformation of the development and the results achieved, for example in-depth discussion of Foshan "three old" reform the practice of the situation in Guangdong. Chapter IV, "three old" reform policy and the relationship between the current real estate legal system, the "three old" reform policies and the existing legal system to compare real estate, and expounded China’s current real estate legal system defects and shortcomings, are discussed the "three old" transformation of existing real estate laws and system innovation and breakthroughs. Put forward the idea of improving the legal system of real estate. Chapter V, "three old" transformation of the sound, that the "three old" problems in the process of transformation, a complete set of recommendations.
