Abstract


SMEs as China's market economy is an important subject, and have a significant impact on the promotion of economic development and social progress . However, the road to the development of SMEs in China is quite bumpy , especially the constraints of the lack of funds for the survival and development of SMEs . The formal financial system can not meet the funding needs of SMEs , the majority of small and medium enterprises will find other ways , private financing by SMEs favor its convenient, efficient and flexible own advantages , gradually become the main mode of financing of the SME . China 's existing laws and regulations on private financing is not yet clear positioning , private financing is still in an awkward position between legal and illegal . In addition , due to the lack of effective regulation of the legal acts of private financing for SMEs , SMEs conducting private financing often easily accessible legal bottom line , onto the criminal path. This is not only conducive to the development of small and medium-sized enterprises , but also affect the health of China's economic development and social harmony and stability , it is necessary to improve the legal system to regulate the SME private financing . Start from the existing laws and regulations involving private financing for SMEs , the status of the legal system to be analyzed to identify the conflict between the legal system and the real state . Meanwhile, the theoretical study of the legalization of private financing for SMEs by building more than one in from abroad to support small and medium enterprises on the basis of legislative experience , coherent legal system of the financial regulatory system and improve the SME private financing to advance the process of the rule of law in the private financing of SMEs .
