Abstract


The sentencing recommendation system is a new topic in recent years, the prosecution in the reform of public prosecutions activities . Some provinces in China , City Attorney organs are carrying out the the sentencing recommendations reform work , and achieved good results . In recent years , some grassroots procuratorate also start to implement the a sentencing recommendation system . Many scholars on this hot issue also showed great interest , began to study the theory of the sentencing recommendation system , and achieved certain academic achievements . Nevertheless, our sentencing recommendation system has not been able to really set up . Based on our justice system 's actual departure from the sentencing recommendation body Procuratorate ' , discusses the establishment of the Sentencing proposed system consists of four parts . The first part is an overview of the sentencing recommendation system . The right to a sentencing recommendation , sentencing recommendation subject specific sentencing recommendation system , provided for the establishment of a sentencing recommendation system theoretical support . The second part of the the sentencing recommendation system for foreign learn . System by the contrast between common law and civil law countries , to identify the beneficial experience of these countries to establish a sentencing recommendation system to provide a reference for our country to establish its own system of sentencing recommendations . The third part is proposed to establish the significance of the sentencing recommendation system . Proposed to establish the significance of the sentencing recommendation system , improve the functions and powers of public prosecution to strengthen legal supervision and optimization of the three aspects of the criminal proceedings and the need for the system established in our country . The fourth part is the idea of ??establishing a sentencing recommendation system to China . Sentencing recommendations from established sentencing legislation proposed system status , the establishment of supporting systems and strengthen the judicial staff to own quality three recommendations , I hope these recommendations provide a realistic foundation for our eventual establishment of a sentencing recommendation system .
