Abstract


Internet is a global information platform , with the openness , uncertainty , interactivity, beyond time and space as well as a huge information transmission , its wide range of applications , and is rich in resources , the use of the Internet to make a large variety of information to be able to get quick , accurate passing . Internet since its inception , has become the object of attention of criminals , especially in the last few years on network crime is not uncommon , and getting worse . Characteristics the network crime concealment , across the region , and data can easily be destroyed , detective work has become extremely difficult . Especially in the preservation of evidence , search and seizure action taken , face technical difficulties in the execution method how to proceed, the judiciary often cause distress in the handling of cases . The legal status of a cyber crime evidence is not too much involved , but the practice there are more and more cases need to be applicable to cybercrime evidence . Judicial practice , the phenomenon of the use of cyber-crime evidence is becoming more common , more and more problems , discuss the basic problem of cyber-crime evidence increasingly attention . Study the basic problem of cybercrime evidence , from the point of view of the system , the existing evidence system better used in which the evidence of cybercrime . From a practical point of view , you can dispel the concerns of the trial evidence of cybercrime , which allow people to accept the evidence of cybercrime . The main objective of this paper is an attempt by the theory circles cybercrime evidence research and practical analysis of practical experience accumulated research on the basis of the concept of cyber crime evidence , connotation , characteristics , types , and current cyber crime evidence preservation explore the problems and the basic problem , trying to eliminate the academic differences cybercrime evidence to clarify the misunderstanding , and effective preservation of the recommendations put forward evidence of cyber crime , in order to purify the cyberspace , the case for the network to provide an effective evidence base .
