Abstract


Criminal Incidental Civil Action is an important system in the criminal proceedings . On the one hand , played a positive role to solve victim offender infringement compensation . On the other hand , due to the Code of Criminal Procedure to exclude the right of victims to obtain compensation for moral damage , coupled with incidental civil provisions simpler With the in-depth study of tort law , especially the expansion of personality rights , criminal incidental civil litigation in trouble .
