Abstract

Food safety has been the most public one of the concerns, especially the "Sanlu milk powder", the food safety issue is pushed to the cusp. With the "Sanlu milk powder" incident gradual exposure, for the "Sanlu milk powder," the trial has started slowly, academia is for "Sanlu milk powder" in cases of criminal law reflected a widely controversial issues, especially for the people’s court case to trial, the series is showing an unprecedented interest. Through this study, we not only found that "Sanlu milk powder" in cases of criminal law contains, can also better understand the speculative problems, even through the case study, found that criminal law exists in food safety these shortcomings, can improve our system of criminal law protection provide constructive input.Through this study found that food safety is a collection of crime in this collection contains a variety of large and small sins, sins and crimes, such as often occurs between the competing, issues like conflict, even if is defined for a specific crime in the dispute may appear on both, for this requires further in-depth theoretical study circles, to form a mature theoretical system, to better guide the work of judicial practice.This paper uses the "Sanlu milk powder" series as a case study perspective, widely adopted 100 long and comment on the author’s understanding of the case. In the case analysis section of this paper is divided into three blocks. The first chunk is a brief "Sanlu milk powder," the basic facts. The second chunk is based on academic and academic point of view to extract the three-point focus of the dispute, namely, the production of "protein powder" Moumou crime qualitative issues; Chairman Tian Moumou crime qualitative issues; Sanlu Group crime qualitative issues.
