Abstract


This paper uses qualitative analysis , comparative analysis and other methods , for consumer credit guarantee insurance issues related to research legal system . The first chapter is the overview of consumer credit guarantee insurance , introduced the concept of consumer credit guarantee insurance , characteristics, historical origins and other infrastructure issues , specifically consumer credit guarantee insurance positive effects. The second chapter is the focus of this article , is currently a hotly debated issue . Consumer credit guarantee insurance or the insurance law is to ensure that property ? This debate will determine the consumer credit guarantee insurance law applicable rules of judicial practice of great significance. I believe that the decision to an object attribute is its essential characteristics , analyzing consumer credit guarantee insurance laws properties depend on its essential nature is consistent with the essential attribute or ensure compliance Insurance essential attribute . The author discusses the essential attribute of guarantee and insurance , on the basis of analysis of the consumer credit guarantee insurance law attributes to clarify its insured properties. The third chapter discusses the consumer credit guarantee insurance in the birth of our country and in our market status quo. Chapter IV discusses the North American countries loan guarantee insurance legal system and its supporting systems , the author mainly from North America loan guarantee insurance legal system , personal credit system, as well as industry associations and insurance regulators examine three aspects of the system and conducted assessment, to later learn from the experience of other countries improve our loan guarantee insurance contract system and its supporting systems laid the foundation. The last chapter the author will apply the theory discussed earlier practice , combined with our loan guarantee insurance status of the legal system , improve our proposed Consumer Credit Guarantee Insurance Legal System recommendations: speaking from the insurance -based approach to improve the assurance insurance legislation ; from the insurance regulatory law is to strengthen the consumer credit guarantee insurance support and supervision ; finally put forward a sound consumer credit guarantee insurance related measures .
