Abstract


Government procurement is an expenditure that with public finance expense for the purpose of maintaining and supporting government policy and system (?) The huge purchasing amount of money usually will be 10%～15% of Gross National Product, it plays of a certain degree of controlling force and influence to national economic development(?)How to arrange and use such a huge amount capital is an important question for national financial and economic development(?) To administer the state according to law is unchangeable principle for government, thus, Government Procurement Law is an important basis and code of government procurement conduct(?) The purpose and legislative spirit of Government Procurement Law is for financial capital efficient and effective usage from active and positive aspect and for corruption prevention from inactive and passive aspect, nevertheless, for government procurement, to well control the corruption or not will impact directly into government procurement capital’s effective use, however, law will be meaningless and lack of significance if without effective execution, therefore, in order to make the legislative goal of Government Procurement Law work well, the means of relief will stand in critical position(?)What the thesis study is about comparison of the means of relief of Government Procurement Law between China Mainland and Taiwan3, about what is the same or different, especially focusing on the discrepancy portion in which problems will happen as concrete practice, which one can reach the goal of fair and open with more effectiveness(?) Somehow currently although there is division in politic between both sides but with inseparable race and culture,in view of 2 signatory parties of Government Procurement Agreement in WTO, through Comparative Jurisprudence study method, to establish and reach a more consistent relief procedure on both side, that is the main purpose of this research(?)
