Abstract


With the further promotion of the municipal utility market-oriented reforms, the operation and management of urban sewage treatment projects under our country’s BOT mode is still in the state of exploration. As the institutional development of current government regulation is lag seriously, its regulatory behavior can not meet the needs of the development of urban sewage treatment under BOT mode.Through taking advantage of principal-agent relationship of the principal-agent theory, this thesis summarizes the core objective of the government regulating the urban sewage treatment projects under BOT mode is to achieve the maximization of the public interest.Urban sewage treatment projects under BOT mode have two significant sides of principal-agent relationship. This thesis makes research from the perspective of government regulation, and deduces that government has double identities of the initial agent and the end principal. According to the basic contents of incentive regulation theory, this thesis analyzes that government should employ the incentive and restraint mechanisms rather than mandatory control or laissez-faire control to regulate the urban sewage treatment projects under BOT mode.Combining cases with typical meaning of the urban sewage treatment projects under BOT mode, this thesis analyzes problems existing in the government regulation from the perspective of principal-agent relationship and incentive regulation. These problems are mainly manifested as follows. The first is that the government regulation is lack of related supports. The second is that there are legal obstacles when government performs regulatory responsibilities. The third is that the status of the principal-agent relationship in government regulation is unclear. Besides, the government regulation is lack of effective incentive and restraint mechanisms and internal control mechanism. Finally, government regulation lacks governmental regulators with professional quality, etc.In order to solve problems stated above, this thesis draws relevant ideas of principal-agent theory and incentive regulation theory, recommends establishing the government regulatory framework of urban sewage treatment projects under BOT mode, improving relevant laws of BOT mode, standardizing the government regulation, transforming governmental regulatory philosophy, positioning principal-agent role correctly, especially taking ternary-based government supervision and restraint mechanisms, and strengthening the building of the government regulation ranks.By way of implementing these regulatory strategies and measures, this thesis attempts to improve the government regulation of urban sewage treatment projects under BOT mode, make BOT mode exert its advantages in the urban sewage treatment projects, and ultimately realize the government regulation object of maximizing the public interest.
