Abstract


The labor contract with unit of choose and employ persons, laborer is the establishment of the Labour relationship make clear the rights and obligations of the agreement, for regulating labor market and stable optimized configuration of human resource and plays an important role. In the practice, the labor contract is still widespread, liquidated damages in labor contract to the understanding of a clause of the liquidated damages and applicable on many occasions, still use civil contract theory, and breach for labor liberty independent ’type of conflict.Therefore, the labor contract law to protect workers from interests, liquidated damages to the terms and conditions of the strict limit, also be necessary to clear up the labor contract of the specific terms of the liquidated damages for the weak, and to protect the rights of workers.
