Abstract


In recent years, the credit cards are experiencing fast growth in China, which brings convenience to most of the credit card holders and also made great contributions to the progress and prosperity of China economic development. However, due to the lack of corresponding risk management and consumer protection measures, the rapid growth of credit card brings a set of problems. As the important participants of the legal relationship of credit card business, the card holders cannot enjoy their basic rights. The rights of card holders are often seen to be violated.This paper points out several shortages that exist in the protection of card holders’right in Chinese law, and uses the challenges which the credit card holders are facing as the starting point, approaches in deep study of the protection of card holder’s rights. The whole paper is divided into three sections.The first chapter introduces the basic elements of theory of the rights of credit card holder, which include the definition and function of credit card, the parties involved in the credit card transaction, the particularity between issuing bank and card holder, then analyzes the legal status of card holder. This chapter points out the necessity and importance of protecting the rights and interests of card holder, and builds the foundation for the following study.The second chapter uses a typical case to illustrate several problems in the credit card transaction for the card holders, which relates to the right to know information, right to privacy, fraudulent use of credit card and right to defense. It then researches the card legislation of other countries and districts so that we could make reference to the experiences in other countries.The third chapter makes some in‐depth consideration on the improvement of the protection of card holders’right, and some suggestions to improve legal regulation of credit card business in China. It makes reference to the legislative system and monitoring system of foreign countries, tries to propose the construction of a concrete system to protect the rights and interest of credit card holders, provides relevant recommendations on the“Regulations of Bank Card”with the purpose of reaching balance between development of the credit card industry and the protection of the card holder’s rights.
