Abstract


This article through to the Canadian capital market insider trading status, the research of current situation of the government regulation of insider trading, the problem of legal regulation of insider trading in Canada, the insider trading case investigation rate is low, low rate of criminal charges and conviction rates low and light punishment, namely insider trading laws regulate basic is invalid. In this paper, and then from two aspects of legislation, law enforcement, explore the reasons of the existence of problems, and points out that the dominant idea behind and Canada regulation of insider trading system, and management authorities, the courts, the investing public and scholars to treat the attitude of the insider trading are inseparable. Finally elaborated the Canadian research brings to our country insider trading laws for several enlightenment. Pointed out that China's legal regulating insider trading is not purely legislation or law enforcement issues, but a system comprehensive legal operation issues. Legal regulating insider trading in China requires not only corresponding legal system guarantee, need all-round crackdown on insider trading legal consciousness, more efficient and effective for insider trading laws provide legal cultural environment.
