Abstract


Since the establishment of the standing committees at each level of the National People’s Congress at 1979, the grass-roots level People’s Congresses and their standing committees performs its supervising functions according to law continuously and innovatively, which makes an active influence on the security of people being the masters of the country and the construction of democracy. However, it is the weak link in the supervision work of district People’s Congress and its standing committee to exercise its powers to supervise through financial of the government. On the basis of my own practice and analysis through the acknowledgement of the theory, I will do some study to explore how the District (County) People’s Congress and its standing committee exercising its financial supervision and operating its function better from the status in quo of the Shanghai District (County) People’s Congress.The main method to supervise through financial is to audit the governmental budget. It is one of the significant parts in the supervision of the People’s Congress according to the constitution and laws. It also is the means to promote financial management in accordance with the law, to ensure that revenue derived from citizen and got used of citizen. With China’s economic construction and the development of democracy, it became a common sense in all levels that the supervision of the People’s Congress to government should be strengthened and the effect on publicly financial operation should be boosted in order to expend the tax best.However, the practice in the late 30 years shows that the powers of supervision of the local People’s Congress on the financial haven’t been exercised completely and have not obvious effects due to public finance supervision. There are a lot of reasons, which lead to invalid method, weak operation and unsatisfied result of supervision, including the expertise and sensitivity of budget supervision, the incomplete content and exercising difficulty of some rules and laws, the limitation of the People’s Congress itself and etc. Thus, there are some meaningful problems and subjects, which are also one of the important links of maintaining and improving the People’s Congress system, for us to study, for example, how to improve and strengthen the financial supervision, how to promote the result of financial supervision, how to let people know the tax expenses and how to control the public power and prevent corruption.It is pointed out in the report of the 17th Conference of Communist Party of China that it is necessary to deepen the reform of the budget system and strengthen budget management and supervision. The study on the financial supervision of the People’s Congress and its standing committee is contributed to boost the progress in district socialist democracy and socialist legal system, prevent the public authority dissimilation, fulfill the supervisory duty legally of the People’s Congress, and advance public finance construction. This article starts with the theory expounded on the District (County) People’s Congress exercising financial supervision, gradually introduces the supervision of the processes and practice through the study of literature, empirical research, case studies and comparative research methods. The article not only makes the analysis of the financial supervision of the status quo and problems analysis of the institutional mechanisms and systems on the negative factors, but also puts forward a reform proposal. It regards the District (County) People’s Congress as the sample for the study. First, this level of the People’s Congress is directly in the face of local grass-roots organs, closely related with the broad masses of the people. Compared with the National People’s Congress, the local People’s Congress exercise the financial supervision more actively and a number of innovative mechanisms and practices are from the local People’s Congress standing committee to explore step by step after reform and opening-up; Second, Shanghai, as an international metropolis, which has the characteristics of concentrated population, economic prosperity, fast development of urban construction and frequent exchanges in education and human resource-rich, may face more complex and prominent economic problems and social conflicts compared to other places. As the vanguard of China’s reform and opening-up, the examples and effects of the District (County) People’s Congress of Shanghai and its standing committee supervision provide a good reference to other parts of the National People’s Congress.
