Abstract


Revenge originated in the Original period, after the law been formulated, the revenge of phenomenon is restricted mainly by the law,but also with a certain degree of tolerance. In ancient China, many thinkers have put forward their own views for revenge, The china ancient thought of revenge development from simply revenge by discussing with the result of the revenge case to the design of the processing program of revenge. The china ancient thoughts of revenge is a microcosm of propriety combination, in the process of propriety combination the thoughts of revenge in ancient China is in impact of the Confucianism, it is difficulty to opposed to revenge. In ancient China, the Confucianism had a certain influence for the revenge case and the relevant legal of revenge.In the adjustment of ceremony and law, the number of revenge cases is changed,but it does not disappearThis paper discusses the following four sections:The first chapter mainly introduces the concept of revenge, the chapter is mainly to the origins of the related concepts and revenge definition. The second chapter is mainly introduced of history of Chinese ancient revenge, divided into the han dynasty, the han dynasty to tang dynasty, tang dynasty, after tang dynasty, four time period of to. introduced. The third chapter analyzes the Confucian thoughts of revenge influence, mainly analyses the Confucian heavy ceremony light law thought, "filial piety" thought, "DE ZhuXing auxiliary" and "the original heart convicted for revenge," principle legal thought influence. The fourth chapter analyzes the influence of revenge legal thoughts,the chapter analyezs form the revenge legal thoughts influence on Judicial and legislative, the mainstream values, and the influence on revenge behavior, and the analysis of three aspects.
