Abstract


The important function of the system of Real-estate Registration in the Real Right Alternation is self-evident since it is of great significance to protect the safety of people’s treasure by maintaining the order in trading real estate. Although some general provisions on how to compensate for the mistakes in Real-estate Registration have been formulated like the 21st article in Property Law by defining their respective rights and obligations for the Parties and the Registrar, this article is far from being comprehensive and refined by giving no attention to the following problems such as the nature、principle、scope of compensation as well as the way of claiming the compensation and the sources of funds for compensation, resulting in the obscurity in establishing the theory of the Legal Responsibility for Wrong Registration of Real Property and the difficulty in operating it in practice.By focusing on the analysis about the nature of the Legal Responsibility for Wrong Registration of Real Property from a practical prospective, the thesis discusses some related issues such as Imputation Principles and different situations in the Wrong Registration. After comparing different regulations about Registration of Real Property in different countries and areas, the thesis also tries to propose the writer’s own ideas on the shortcomings in the present the Civil Responsibility for Wrong Registration of Real Property with the aim of improving it.
