Abstract


Invasive species on the economy , human health and biodiversity caused great harm , has become a global bio- pollution problems. Invasive alien species prevention and control how the law , legal theory in today's environment is one of the hot issues . Which the international community and the world's major countries have developed a number of legal documents , to deal with the increasingly serious problem of invasive species . China's current situation is that no one specialized in managing invasive species laws, and laws and regulations that already exist , there are many yet to be perfected. In the presentation and analysis of the concept of alien species , invasive alien species and pathways hazards , as well as the international organizations and the world's major advanced countries in the prevention and control of alien species invasion of the legal measures taken on the basis of the achievements of our country alien species invasion situation , China's prevention and control of invasive alien species to analyze the status of legal measures , identified after comparing our current prevention and control of invasive species with regard to the legal existence of a series of measures deficiencies , and finally how to improve our prevention and control of alien invasive Species legal system proposed approach . Summarize the prevention and control of invasive species, not only biology, physics , chemistry and other scientific methods , more importantly, from a legal level to implement prevention and control measures for invasive species ; First, China should learn from international advanced legislative experience , updating legislation idea , a clear legislative intent. Second, China should develop a prevention and control of invasive alien species, a special law , strictly follow the relevant legal principles , and to build and improve the prevention and control of invasive alien species in a series of legal systems. Again, the law enforcement team to train high-quality and clear responsibilities of relevant organizations and the responsible person liability. Finally, to clear the prevention and control of invasive alien species management organization and management system , setting a unified and coordinated management procedures. Contribution of this study is not to propose an innovative theory , but rather on the existing legal theories , practices complement and reasonably, expect to achieve in this field of research , serve , and to attempt to make up for the little research in the field of prevention and control deficiencies and on the practice of invasive alien species to provide a reference and support.
