Abstract


Labor relation is an important part of social relations, which relates to the social harmony and stability. Labor relation has changed with the social development. At the same time, more and more new kinds of labor disputes have emerged. Litigation has played an important role in the settlement of labor disputes as the last barrier to protect social justice. The litigation is still the first choice after implementation of new laws by survey. On the contrary, effect of other ways has become much weak. But litigation has its own unavoidable disadvantages. In addition, labor dispute lawsuit system in China is not act perfectly to resolve disputes and to balance interests. Writing goal is put forward some proposals to labor dispute lawsuit system in our country by investigate the interaction of social interests with law-sociological methods. The thesis emphasize that it’s an inevitable choice to establish a multiplex resolution system of labor dispute.Except the introduction and conclusion, this thesis is divided into four parts:The first chapter analyzes the important role, which labor relation has played,and defines concept, features, types and reasons. At last, this chapter reveals the features of labor dispute lawsuit system by compare with litigation.The second chapter investigates labor law-suits of three primary courts in 2008. The target is to find the practical effect of the labor dispute lawsuits system.The third chapter analyzes the pros and cons of the labor dispute lawsuit system at basis of empirical investigation and interaction of different resolutions of labor dispute.The forth chapter elaborates the guiding ideology and basic principles, which is how to perfect the labor dispute lawsuit system. At last, this thesis put forward the proposes about how to improve the system.
