Abstract


Since the reform and opening up , China 's economic and social development and continuous improvement of people's living standards . But economic development while also causing damage to the environment , China 's environmental situation is very worrying . Although China has developed a lot of environmental protection laws and regulations , China 's legal system is not perfect, especially in the aspects of soil pollution prevention , not on soil pollution prevention specialized legislation . Soil is the material basis of human survival and development , and an important part of the ecological environment . The soil environment not only affect China's economic development , but also directly related to China 's food security and people's good health and many other issues . Soil pollution problem has become an important factor restricting China's economic , social and environmental harmonious development . The purpose of this study is that the formulation of Soil Pollution Control Act , and the perfect soil pollution control legal system in China , promoting the pace of China's legal community . In this paper, based on a comprehensive understanding of the status quo of China 's soil contamination and soil pollution caused by China 's economic and social development and human health hazards , the integrated use of the method of analysis , examples, comparisons demonstration research , learn from the developed countries in the soil pollution prevention legislation advanced experience and the lessons learned in this process , the proposed legislation on the prevention and control of soil pollution in China to develop ideas. First , soil pollution prevention legislation to follow the following main principles : the principle of maintaining the ecological security , the principle of sustainable use of soil resources , and the principle of state intervention , the polluter governance principles and the principle of national relief , the principle of public participation , accountability principles of soil pollution , agricultural soil the special protection principles , these principles play a crucial role in legislation ; followed by soil pollution control legal system : system of soil environmental standards , soil pollution monitoring system , impact assessment system of soil pollution , soil pollution information disclosure system pollution emergency management system , soil pollution deadline governance system , pollution repair system ; final adoption of the strict liability provisions , to ensure the implementation of the \
