Abstract


The development of the Internet, caused the network copyright infringement, the paper discusses the problems for Internet development indispensable network service provider of tort liability, how to deal with Chinese and foreign countries are widely discussed, from direct to indirect infringement infringement, from port system to the red flag standard. But the author discusses and analyses the content of the system after think, whether port system or red flag standard, for the network service provider of tort liability imputation principle in essence and not from the traditional civil law, civil tort imputation principle for web services to provide the responsibility identification is still to see whether there is the subjective fault, if there is subjective fault, it shall bear compensation responsibility, if there is no fault, do not assume tort liability.
