Abstract

In a constitutional system, good running society, members of society have a good sense of civic responsibility is their common features. Research into State constitutional history, we find that the rise of Western Europe from the Middle Ages towards the brunt of the modern process is equal rights, property rights, the right to vote and other civil rights awareness. The rise of awareness of their rights and the development of the commodity economy in Western Europe, the tradition of the rule of law, and society as a whole has a great relevance in the spirit of the contract, and the overall rise of rights consciousness and eventually to the establishment of democratic politics and the formation of the civil society. But the majority of Chinese people from a real qualified citizens is a long way off. China also need enlightenment it? Was asked the question, the author's answer is yes, and that enlightenment not only by scholars and elites preach education, and more to rely on the system to reform itself. Rural China created the local character of the Chinese people, the Chinese people to develop in the two thousand years of imperial tradition does not meet modern color concept is still rooted in the people's thinking, which means that China's transition will be a difficult and lengthy the process, and not enough to make any optimistic estimate. From four aspects, awareness of civil rights from the point of view of constitutional jurisprudence.
