Abstract


In the west, the mistake of victim has positive significance on criminal law. It reduces the legal responsibility of the conductor.But in criminal law of China,we pay little attentation to it, and merely put it in the judicature in the discretion of punishment to deliberate the plot to treat. However we take little into consideration in the actual operation. This indicates our country ignore the victim’s main body status in the criminal law. Currently in effect person composes in reply the people’s behavior corporal punishment theory system middle for the centre in order to committing a crime, the angle in effect isolatedly committing a crime, people’s host objective fact is a basis single-faceted in order to committing a crime, analyse if whose behavior compose committing a crime and owe a place the multiple penalty, responsibility, this criminal upper unfair phenomenon having ignored due role of the victim and should bear it ought to change.This is known to all these inadequacies, the main body of a book attempt the ken expanding corporal punishment theory research. It is in prey to the victims of the interactive relationship with, trying to have research on the basis of uses such means, the integration of the offence of criminal law applicable to the victim of this matter in a systematic approach. For criminal offence by the victim of the logical and types of analysis, judicial and evidence, the influence of the blame for an in-depth analysis, the plot of the victims felt to blame for the legislative proposals to the fairness and justice, on the right to life in actually.
