Abstract


In recent years, as people to pay more attention to human rights protection degree of gradually improve, the more and more countries and organizations in the legal documents to the illegal evidence elimination rule to make the rules. Our country is no exception, though in the criminal procedure law did not make clear a regulation, but projects, three department on July 1, 2010 and promulgated the "about the handling of criminal cases excluding illegal evidence the provisions of a certain number of problems", marked the illegal evidence elimination rule in our formal establishment. Yet the provisions on the scope of the illegal evidence elimination and ruled out the specific operation procedure there is still a shortage, and lack of related system compatibility. Based on this, this paper has from illegal evidence rule concept and connotation of the value of the illegal evidence elimination rule and function and legislation in our country present situation and theoretical research to carry on the analysis, proposed own view, and to our country there is no system to establish the cause of the illegal evidence elimination rule carries on the elaboration, finally to construct and perfect our country's illegal evidence elimination rule and related supporting system construction put forward a concrete idea.
