Abstract


With our county economic rapid development, water resources are facing tough challenges. In Many areas groundwater there have been over exploited leading to the huge funnel areas and large-scale pollution. At the same time, the intensity of groundwater overexploitation is also increasing. It has caused a serious of ecological problems, such as land subsidence, seawater intrusion, etc. These have been disturbed the normal production and life of people. At present,a variety of separate set of legal provisions to protect ground waters resource , such as Water Law of the People’s Republic of China”,“Law of the People’s Republic of China on the Prevention and Control of Water Pollution”and some local laws and department regulations. These provisions have not strong feasibility. In order to achieve objective about the groundwater resources sustainable utilization and achieve social, economic, and environmental development, we should be formulate precautionary principle and the principle of unity .Base on the two principles to formulate groundwater planning regulation, establishing water-intaking permit system, comprehensive evaluation and groundwater function zone regulation, set out "Groundwater Resources Management Act."Firstly, this paper introduces the relevant concept of groundwater resources, described the problems of groundwater, pointed out existing regulations inadequate areas .Then describes the European Union, the United States and Australia, the three countries advanced legislative experience. In the fourth part of the concept from the legislature philosophy and the basic principles to provide the theoretical basis for the perfection of formulation . Finally, establish and improve relevant legal systems and auxiliary system to improve the legal system of groundwater, in order to achieve our objective of sustainable utilization of groundwater resources.
