Abstract


College teacher employment system is an important part of our university personnel system. Both in theory and in practice, there are more controversial, is also facing a number of challenges, resulting in the appointment system of college teachers in practice is difficult to have made substantial progress. One important reason is that research universities involved in teacher employment system problems through a lack of consensus. The appointment system of college teachers of this study include the legal nature of the legal status of higher education institutions, the legal status of university teachers, rights and their protection, university teachers appointment contract effectively appointment system implemented supporting policies to promote college teachers. No clearly defined legal status of our institutions of higher learning in the existing laws and regulations. In accordance with the provisions of the General Principles of the Civil Law, colleges and universities should belong to the legal institutions. Also suggested that colleges and universities authorized organizations, laws and regulations and the administrative body eligible colleges and universities, as special government implementation of the higher education institutions, must accept the government's management, to obey government orders. \Terms of our country, the legal status of the university teachers from two aspects to analyze: (1) the relationship between teachers, educational administration and the laws and regulations of the authorized organs, both between the administrative body and administrative relative education administrative legal relationship. (2) the relationship between the teachers and the school corporation, both the legal relationship between the expression of the common will and the dominant position on the basis of equality.
