Abstract


Civil service disciplinary system is a form of punishment given by the national authorities of the violation of the obligations of his office or the duties obligations on the command - based civil servants , state organs for a management of the civil service , civil servants bear administrative liability forms of discipline , and its essence on may damage the interests of the civil servants . Currently, the legalization of the civil service has been the development trend of the modern civil service , civil service disciplinary system is an important part of the civil service system . World generally through legislation in the form of civil service disciplinary system has made provisions , the establishment of a civil service disciplinary system , has important implications for the management of a national civil service and the rule of law and the safeguarding of the legitimate rights and interests of the civil servants . Study this problem lies in the civil service disciplinary system has been established the legal basis is it? What is the legal connotation ? Historical process and the status of China's civil service disciplinary system ? How the reform of the civil service disciplinary system ? These problems thinking , constitute the framework of the research for this article . The paper is divided into four parts . The first part discusses the history of China's civil service disciplinary system , system analysis is divided into five historical stages of the civil service disciplinary system , the beginning of the cadres discipline to the subsequent establishment of the civil service disciplinary system . The second part is the construction and characteristics of China's civil service disciplinary system , build a general theoretical basis of our civil servants from civil servants to build a legal basis and legal basis on two aspects ; from our implementation of the main civil service disciplinary system , disciplinary subject matter and the type of aspects of the civil service disciplinary system , disciplinary procedures , disciplinary relief , disciplinary or termination of a systematic and comprehensive analysis . The third part of the disciplinary system contradiction analysis with regard to further illustrate the problems and solutions of the disciplinary system in the implementation process . The fourth part discusses China's civil service disciplinary system in terms of the rule of law , democratic , efficient , honest, open, diligent, and people-oriented functionality to build a service-oriented government .
