Abstract


With speeding up of urbanization process in China, a large number of land acquisitions appeared. Farmers who lost their land can not protect their vital interests in acquisition process suffering decline of living standards. Key issue is Land Expropriation Compensation Institution of land acquisition in rural areas. Today’s compensation Institution has exposed many shortcomings in the development of market economy and Land Expropriation Compensation issue have become a major factor which influence economic development and social harmony. Therefore, improve Land Expropriation Compensation Institution have profound practical significance for the protection of legitimate rights of peasants who lost their land and establishment of a harmonious society.This thesis set forth this social hot spots, using theoretical analysis and empirical analysis to study Land Expropriation Compensation Institution. First, domestic and abroad current research situation on Land Expropriation Compensation Institution are described and summarized, related theories are meticulously analysed.Establishes theoretical basis for this study. Second, by analyzing the history of evolution of Land Expropriation Compensation Institution and defects and causes of the existing institution, propose path selection to improve the existing institution. Finally, take land expropriation case of Wujiagang District in Yichang City as a positive analysis and this positive analysis demonstrates the rationality of the path.This study indicate that: establish and perfect land expropriation compensation market mechanisms and evaluation mechanisms, stakeholder participation mechanisms, land expropriation compensation negotiation mechanisms, land dispute resolution mechanisms and the full play of the linkage effectiveness of these mechanisms provides constructive suggestions for the Improvement of Land Expropriation Compensation Institution.
