Abstract


Our private equity investment fund industry began in the 1980s , after 20 years of development, become an important means of corporate finance , and promote the prosperity of the market economy . However, due to the lack of relevant laws , imperfect, related measures and specific management measures and implementation lags , the development of private equity funds , there are many legal vacuum , largely hampered China's private equity investment funds and the market development . Compared with the rapid development of the industry , China's private equity investment fund industry regulatory system construction and supervision system is very immature. Therefore, how to learn from foreign experience and the maturity of China's specific national conditions combined to build and improve our regulatory system of private equity investment fund , has a very important theoretical and practical significance . This absorbs the domestic and foreign private investment funds for research, on this basis , from the introduction of private equity investment funds meanings and characteristics of the basic theory to start ; in the study of domestic and foreign private equity investment fund development status , the private equity investment the necessity to regulate the Fund were analyzed ; then it focuses on analysis of the domestic private equity investment fund regulatory status quo and problems ; final analysis by comparing the United States, Japan and other developed countries, the United Kingdom and private equity investment fund regulatory regime , combined with the U.S. financial since the crisis, private equity investment fund regulation the latest trends , made ​​China's current private equity fund regulation of the basic principles and direction of the market , and how to improve our future private equity investment fund regulation put forward some concrete proposals . That our country should be market access, qualified investors , the fund manager qualifications and information disclosure as soon as possible on the issue of private equity investment funds related legislation , build in line with China 's national conditions, in line with current practice requires private equity investment fund legal and regulatory system , and more good to regulate the operation of private equity funds . The private equity funds into the legal system in protecting the interests of investors , maintaining China's capital market stability while promoting China's private equity industry.
