Abstract


Unemployment insurance is an important social insurance system, which refers to the unemployed not because I desire a source of workers temporarily interrupted to provide material assistance system. Unemployment insurance system is to protect the two basic functions of the basic livelihood of the unemployed and employment promotion . In legislation and in practice , since values, resource constraints and legislation and the specific implementation of different angles on the bias, unemployment insurance is often difficult to simultaneously achieve two functions of the legal system , or tend to subsistence -oriented , or the tendency to on employment promotion -oriented . Reasonable unemployment insurance system can effectively promote employment, unemployment insurance system is unreasonable for the promotion of employment causing obstruction . Guarantee the basic livelihood of the unemployed remain unemployed security system is only one aspect only expedient, to promote re- employment of the unemployed to get through labor stable life and dignity of the individual is the fundamental objective of the unemployment insurance system . The unemployment insurance system in the development of the beginning, due to economic constraints and institutional constraints of the level of economic development , which is more focused on the protection of the basic livelihood of the unemployed , and in promoting re-employment of the unemployed , the lack of employment promotion of rational functions design and proper arrangements . China's current employment situation is not optimistic , and increasingly serious unemployment crisis and unemployment insurance legal system functional deficiencies employment promotion in employment promotion requires us to rethink our concept of the unemployment insurance system.
