Recently there are two challenges in the world,one is climate change,the other is energy crisis.New energy technology is an important way to change this difficult situation. As the developed countries had researched in this field for decades before us,and from the beginning they focused intellectual property protection ,they are in a good position.So,we have to try our best to catch them. In China , the new energy industry is developing rapidly, especially in two areas such as the solar photovoltaic technology and wind power technology, however, there are many issues. The most negative factor is the lack of core technology,causing our industry in the downstream chain, most of the profits have been obtained by multinational corporations.To change this situation, we must study intellectual property protection system of our country, and know how to use our own advantages, with reference to countries in the world to make improvements.Patent system is a good mechanism, which protects technological innovation, and maintain fair competition. Researching and developing new energy technology of our own Patent system is our top priority. This article is about how to build our own Patent system, to give new energy technology more protection.The first chapter mainly introduces the status of new energy technologies and technical characteristics, such as Solar PV technology,wind power technology, biomass energy,etc.And there are some words to explain the connetions and differences in new energy technology and green technology.The second chapter mainly describes the proplems in the course of the development and use of new energy technology, primarily the lack of core technologies and important technologies of intellctual property ,leading the development of new energy industry to a bottleneck stage.The third chapter mainly introduces the other courntries in the world, especially the developed countries ,how to use their patent system to protect new energy technologies, including a quick review of green technology access, compulsory licensing, and Patent Commons.The fourth chapter describes our patent system as a start, mainly introduces the conservation status of the protection of new energy technologies with the patent system , compares the system of foreign countries, finds the inadequacy of our system,and make some questions.Chapter V mainly analyzes the patent system how to make improvements,with the problems in the process of developing and using new energy technologies, making recommendations on the object in the patent, patent review and patent licensing .
