Abstract


China 's securities market has experienced 20 years of development has made remarkable achievements in economic development for the community has made great contributions , but against the interests of investors in securities cases have occurred frequently, especially securities insider trading has become one of the securities market big ills. Although in 2006 the \Therefore , insider trading victims through access to the courts to obtain civil compensation , there are many obstacles. This paper focuses on mechanisms of action perspective , insider trading in securities civil compensation issues were discussed. The thesis consists of an introduction, body and conclusion of three parts. Discusses the text is divided into four parts : Part I: insider trading in securities to define the concept of civil compensation , insider trading in securities civil compensation necessity of exposition. Insider trading and securities litigation and general civil compensation is to distinguish between civil action for damages , and finally discusses the securities insider trading civil action for damages with the function . Part II: traces of securities insider trading history of the development of civil action for damages on the current securities insider trading civil suit for compensation in the form of pre- litigation procedures and aspects of the disadvantages are analyzed. Part III : Foreign securities insider trading civil legal regulation to the introduction of foreign securities insider trading civil suit for compensation in the form analysis and comparison , the United States obtained the form of class action to solve our securities insider trading civil suit for compensation with reference. Part IV: China's securities insider trading civil action for damages System. From lawsuits jurisdiction to cancel the pre-procedure , as well as the form of class action and other aspects of the establishment of recommendations to promote China's securities insider trading civil suit for compensation regime fully perfected.
