Abstract


Since the reform and opening up in China , multinational corporations are also mushrooming development . Followed my legitimate rights and interests of multinational companies is also increasing in foreign been infringed . Therefore, to explore how multinational companies better diplomatic protection is of great significance . The principle of diplomatic protection is a traditional principle of customary international law . It is to based personal jurisdiction generate . However, with the continuous development of globalization and integration of the world economy , the institution of diplomatic protection , especially in the field of diplomatic protection of transnational corporations encounter new challenges . In this paper, the general problem of multinational diplomatic protection from the start , analyze its diplomatic protection of diplomatic protection of shareholders conflict resolution , and thus the diplomatic protection of multinationals to make some suggestions . This paper is divided into four parts : The first part introduces the general issues of diplomatic protection . In this section , sub- section provides an overview of the application of the concept and nature of diplomatic protection and diplomatic protection system in multinational companies . The second part describes the conditions for multinational companies to exercise diplomatic protection is the claim of the determination of the nationality and the principle of exhaustion of local remedies . The third part introduces the general problem of multinational corporations diplomatic protection of shareholders . There are close ties to the company and shareholders and independent of each other . The legal basis for this part of the sub-section of the diplomatic protection of transnational corporations shareholders exercise diplomatic protection in the case of the determination of the nationality of the shareholders , the conflict of the multinational corporations and their shareholders diplomatic protection as well as the nationality of the shareholders . Finally, Part IV of multinationals exercise the right of diplomatic protection put forward some suggestions , analysis, and discussed separately from the exhaustion of local remedies principles and determination of the nationality which both sides . This paper tries to diplomatic protection by the multinational corporations and their shareholders a discussion of this idea , and then put forward some suggestions for the better protection of our multinational corporations .
