Abstract


The meaning of the Private International Law range from multi-level understanding . Private international law refers both to the private international law as a discipline of law , the scope of the study , but also refers to a range of private international law should contain legal norms ; refers both to the content of the legislative practice of private international law and regulations , and private international law as a course should the contents set . Varied understanding on the scope of private international law , such as international private law contains a unified entity specification , whether to include foreigners civil legal status of the specification , and whether to include foreign-related civil litigation and commercial arbitration procedural norms , so as to form a distinctive different doctrine , such as large private international law , private international law , private international law and so on. This paper summarizes the many differences exist by the theory of private international law , and to analyze the reasons for its formation and the evils brought , starting from the different interpretation of the doctrine of characteristics to identify the various doctrine where the points of disagreement , the parties held views and reasons through comprehensive representations and contrast , for a comprehensive analysis of the scope of the private international law . The scope of the private international law should not be overextended , nor should it be limited to the conflict rules . Should international civil and commercial matter exchanges between the reality and the International China supplier things cases of treatment practice starting , delineate the reasonable range , including international civil and commercial cases jurisdiction norms , conflict norms and international judicial assist ( including foreign court judgments and arbitral awards of recognition of and execution ) .
