Abstract


The life of the law is that it 's the implementation . Execution of civil cases is effective legal instruments to be realized , it smoothly or not the parties directly related to the ability to obtain a judgment of his interests . The civilian implementation difficult our court has long been a difficult problem to solve the problem , but also attaches great importance to the public opinion . It can be said , the Civil Execution difficult the smooth or not determines the process of building a society based on the rule of law in our country , should be a long-term attention and research . Order to solve the problem of difficulty in enforcement , the use of standardized analysis and empirical analysis and other research methods , the article is divided into three parts , the first part of the understanding of the concepts to perform difficult by comparison and analysis of various scholars , which summarized analysis obtained their implementation is difficult to define , and explains the difficulty in enforcement of harm ; second part of practice data and case studies on the implementation of the performance of the difficult analysis , based on the analysis difficult to perform manifestations , from the two aspects of the legislative, judicial elaborated the main reason for the formation of civil perform difficult , including the civil enforcement of the legal system lags behind the implementation of measures and punitive measures single and court management system defects ; third part mainly on the basis of the first two parts of the civilian implementation of the problem of resolved programs and constructive advice , including recommendations to improve the implementation of legislation , to improve the implementation of measures , reform and implementation of the management system , and a clear implementation of the core position of the linkage mechanism in the civilian implementation of the system aspects .
