Abstract


Civilian implementation of the management system mainly includes civil enforcement agency management system and operational mechanism of civil enforcement powers , etc. , the core is between the upper and lower longitudinal civil enforcement agency management mechanisms . As long civil enforcement powers for lack of proper understanding of the nature , in our civil rights civil enforcement theory and practice of civil trial , tend to its simple equivalent jurisdiction , and follow the trial management model to guide and manage civilian implementation . Civil \relationships do not belong to their own way, work in practice supervision and management is not in place , implementation is difficult to form a joint force. With the recent work on the civilian implementation of the in-depth study , the reform of the court system , primarily focused on the civilian implementation of the management system , the attempt to establish a unified management system of civil enforcement of civil enforcement for unified management and coordination . Reform is correct or not , in the judicial practice of the specific effects appear before the country also needs to be a reasonable theoretical speculation . This article is in this context , the use of the jurisprudence of several major legal research methods , followed by use of logical analysis method, law and economics analysis method, the value of law analysis method, empirical analysis in civil legal implementation of a unified management system theoretical logic , effectiveness , rationality, practical feasibility analysis , thus proving that this reform of the court system was first established in the legal theory , there is a theoretical basis . Build civil enforcement unified management system is conducive to civil enforcement work, is conducive to the operation of the civil enforcement powers , and we achieve justice , establish judicial authority , stable social order , rule of law and building a socialist society, harmonious society is consistent with the objectives .
