Abstract


As a private commercial arbitration to resolve civil and commercial disputes in an important way, is accompanied by its commodity trading generated. it can be said is the history of the development of the arbitration system, ad hoc arbitration system development history. In today,ad hoc arbitration system, when applied in many countries, our country has as yet not willing to give temporary in the legislative system to clear the status of rub, which not only hindered the development of arbitration, but also to the main body of commercial disputes in the international often in a passive position. This article, trying to ad hoc arbitration system from the origin to its unique advantages, and some theoretical issues discussed so as to envisage the establishment of the temporary arbitration system in China.The first part is an overview of ad hoc arbitration system. Defined on the basis of the concept, and further trace the history of ad hoc arbitration system, and analyze the reasons for their existence and values.The second part of comparative analysis, highlighting the unique advantages of ad hoc arbitration system to illustrate the need for the temporary arbitration system.The third part reveals the arbitration system of the present attitude of the provisional and analyze the reasons, trying to trace the origin of the origins and shortcomings of the status quo.Part IV describes the lack of ad hoc arbitration to the overall development of our arbitration brought the cause of obstruction, called as soon as possible to establish the temporary arbitration system in China.Part V of the future envisaged in the interim arbitration system. Arbitration Association to establish a temporary arbitration system under the supervision of hope for the temporary arbitration system in China to provide specific design advice.
