Abstract


In modern society , the knowledge structures become more and more specialized , enter any one of the areas of expertise are required to master the unique knowledge and skills . Based on the limited nature of their knowledge , ability and specialization close , people trust the experts when dealing with matters and rising expectations , experts possibility of abuse of trust to increase, along with experts obligation arising . Lawyer Professional Liability , Professional Liability , China has basically have the responsibility of lawyers expert system prototype , but the relevant provisions still exist some defects : inconsistent legislative provisions , part of the problem has not been clearly defined , the general The theory has not been sufficiently thorough exposition and argumentation , there are many problems in the practice . Protection of the interests of the client or third person in the context of the current information asymmetry is particularly prominent countries through various forms of its damage to be a relief , and achieved very good results , and worth learning . Practices to limit risk and transfer both to protect the legitimate rights and interests of the parties , but also to maintain the enthusiasm of lawyers practicing and promoting the development of the legal profession as a whole to reach the best interests of all parties . This paper draw two legal systems legislative, judicial experience and basic theory , based on research in predecessors for more detailed research and analysis of this issue , and to look forward to some of the establishment and improvement of the system of civil liability of lawyers expert in China benefit.
