Abstract


Nowadays, traveling has became a common thing in our life. With transportation popularization and the improvement of living standard, we can do the long distance tour at the holiday of Labor Day and the National Day or do outings in the weekend. We can relax us and make new friends by traveling. We can travel with an agency or send placard to call self-service tourists on traveling together. In traveling with travel agency, we must sign a contact with travel agency. What is nature of tour contract? we think this less. Despite academies discussing more on nature of tour contract,but they didn’t come to agree on this. With the precondition, writher analysis nature of organized travel contract and intermediary contract. After this, writer analysis nature of self-service tour., that is very popular in recent years. The writer hopes that the discussion may to some extent be meaning full to perfect the legislation and practice on tour contract.The text is divided into five parts:The fist chapter begins by analysis of tour case, we find tourism dispute increasing year by year and there is no special legislation on tour contract, though the study of tour contract is imperiously demanded.The second chapter, in discussing the academic controversy about the nature of organized travel contract, combined with the analysis of tourism dispute, make conclusion about nature of organized travel contract.ChapterⅢ, in discussing the academic controversy about the nature of intermediary travel contract, combined with the analysis of tourism dispute, make conclusion about nature of intermediary travel contract.ChapterⅣ, in discussing the academic controversy about the nature of self-service tour, combined with the analysis of self-service tour dispute, make conclusion about nature of self-service tour.
