Abstract


March 28, 2008 the CPC Central Committee, State Council \people understand, respect, care, help people with disabilities of the good society. \employment of disabled persons, in order to protect important system of equal employment of persons with disabilities. The system is a mode of social participation of persons with disabilities outlook reflects a civilized society, help people with disabilities is fully and equally in society, to achieve its survival and development. However, due to legal defects, the system status of implementation in practice is not so optimistic, many units, especially state organs, institutions and state-owned enterprises is even more reluctant to hire people with disabilities. From a legal point of view this proportion was analyzed employment system demonstration. The first chapter describes the employment system in proportion to the legal basis, that the proportion of employment is social participation mode, an important form of employment for the disabled, reflecting the equality of human rights, justice, social integration and dominant perspective on the concept of people with disabilities, there are help protect the right to life of persons with disabilities, the realization of the right to development. Chapter II, through the proportional relationship between the main scope of employment laws and legal employment in proportion to the content analysis revealed a substantial proportion of the employment system, pointing out that its essence is the way countries have adopted legislation requiring the employer obligation to carry out security disability the social responsibility of human labor rights, and force the employer to arrange a manner proportional to fulfill its obligations and achieve its responsibilities. Chapter III describes the overall situation of the system, problems, noting that an important reason for these problems is one of the legal system, there is a certain lack: lack of proportion to employment law enforceable legal liability provisions; proportion of employment regulations developing too careless, lack rights and obligations specified; proportion of employment insecurity disability rights legislation relief provisions. Chapter IV presents a comprehensive legislative proposal of the system, on the one hand, improve the mechanism to achieve proportional employment related laws and regulations to protect the labor rights of persons with disabilities; On the other hand, improve anti-disability discrimination laws and regulations, improve the legal system of proportional employment.
