Abstract


Underwriter of demonstrative obligation refers to the insurance contract comes into effect before, to make policy-holder can fully understand the contract rights and obligations relations underwriter and policy-holder, the underwriter owes a duty of explanation to the insurance contract content, is usually referred to as "alert". The underwriter demonstrative obligation law system both theoretical features and practical significance. To format contracts, insurance contract is a highly professional and technical characteristics, the underwriter of establishment and improvement of the system of demonstrative obligation is the most direct practical value to protect the interests of the policyholders, balance the insurer and the insured, but to insurance industry long-term stable development. Although our country "insurance law" has established the system, but the law is too principle, some content about the underwriter demonstrative obligation law is not sound, such as insurance agent and insurance salesman's main body status, the insurer means the obligation of means, explicitly specify category, and the legal consequence of breach that, etc., these problems are remain to be perfect in the legislation.
