Abstract


Investigation procedure in the whole criminal procedure in an important position, it is the basis and premise of criminal suit, directly affect the quality and effect of criminal procedure finally. In this paper, by studying the nature of the investigation procedure, the connotation and status, longxi analyzes different law countries world characteristics and development trend of criminal investigation procedure, starting from the investigation procedure, running, put an end to the three stages of in-depth analysis discusses the indictment that exist in the criminal investigation procedure in our country is highly concentrated, the lack of neutral judicial review of criminal suspects rights protection mechanism is relatively underdeveloped and the problem of criminal suspects legitimate rights and interests of vulnerable to invasion and disadvantages. Establishes from the investigation procedure of lawsuit structure, guarantee benign operation indictment, protect the rights of criminal suspects rights, improve the defense lawyers, perfecting the evidence collection and seized the suspect measures, improve the investigation ended six aspects put forward the modify and perfect the relevant provisions of the opinions of the criminal investigation procedure in our country.
