Abstract


High speed of economic development in our country with high crime rates, how to use the limited judicial resources to handle more cases, many experts and scholars put forward the reference topic of plea bargaining. This article embarks from the plea bargaining in China is the first case, the concept of plea bargaining, as well as its generation and development history, and through the analysis of the national practice of plea bargaining, sums up the types and implementation principle of plea bargaining; And then through the analysis of plea bargaining existence value, points out the basis of the plea bargain can be widely used; Then through the analysis of the survival soil of plea bargaining, to point out that the present stage our country the rule of law environment is not suitable for the survival of plea bargaining, so the criminal trial procedure in our country at present stage should not introduce plea bargaining; Finally pointed out, such as transplant plea bargaining in China in the future, should adopt the principle of as well as the transplant plea bargaining in China what should be prepared.
