Abstract


Pirate the common enemy of all mankind ((Hostis Humani Generis), from the onset , it is a tremendous threat to the international community , the international legal order caused by vibration . The pirate phenomenon of the most important reason is that some coastal food and clothing of the people of the backward countries worrying , life there is no extreme security, the gap between the rich and the poor in order to survive , people were forced to take the risk to engage in piracy . , on the one hand, piracy is showing the new features and trends of the industry , networking and modernization to the international cooperation to punish pirates posed a serious challenge ; On the other hand , through the study to punish pirates status of international cooperation , can be found to punish pirates international cooperation there is institutional shortcomings: First , the legislative point of view , the international community does not exist specifically for the International Convention for the crime of piracy , the existing international treaties there is a lack of clarity , coordination and other issues ; Secondly , the administration of justice , the international community did not establish the special hearing capture pirates court ; third, cooperation in punishing the pirates mechanism the operation has not yet been established universal , a dominant force in the strong international cooperation mechanisms , etc. Therefore, the priority of the international community is to perfect the legal mechanisms to punish pirate international cooperation . specific strategies , build Ministry dedicated to the International Convention for the punishment of the crime of piracy ; specialized special court hearing the capture pirates and expand the jurisdiction of the International Criminal Court to the crime of piracy into the ranks of international crimes should be punishable ; Third, the establishment of the United Nations Security Council leading to punish pirates cooperation mechanisms.
