Abstract


Protection of the rights of offenders prison , is the important part of human rights protection . The offender is a special class of subjects of rights , their rights under the law is not serving a sentence for crime loss . For a long time , China's prison work on the rehabilitation of offenders both in concept and in practice , all one-sided emphasis on the offender to submit to management , while ignoring the protection of the rights of offenders . Prison neglect, weaken , or even the right to deprive criminals of the phenomenon have occurred, some even serious violations of the legitimate rights of the offender , such as overload , overtime labor , corporal punishment, beatings criminals , casual place to stop criminals normal case and so on. With the continuous development and strengthening protection of the rights of offenders prison work , has gradually become a democratic and legal construction of China and the international struggle for human rights needs. This paper focuses on the protection of the rights of offenders prison , the structure is divided into three parts. In explaining the basic protection of the rights of offenders prison based on the theory of the Chinese prison status of protection of the rights of offenders , affirmed the Chinese prison protection of the rights of offenders in the legal system construction, material security , oversight mechanisms achievements , especially the \People prison Law \In affirming the achievements , focusing on the protection of the rights of the offender prison analysis of the deficiencies exist , mostly prison protection of the rights of offenders and the enforcement procedures of the legal system is still not standardized ; prison ideologically existence of errors of law enforcement body ; prison for prisoners' rights protection is lagging behind on the material conditions ; prison there is a deviation in law enforcement ; protection of the rights of offenders prison oversight mechanisms are not in place and other issues. The last part of the article discusses the protection of the rights of offenders Chinese prisons perfect path : First, improving the protection of the rights of offenders prison legal system ; Second is to improve enforcement capacity prisons ; Third, improve the mechanism to ensure funding prisons ; Fourth, improve the rights of offenders Relief legal systems.
