Abstract


The judicial authentication system as a modern state law system especially the judicial system is an important part of national law enforcement, the important guarantee. In judicial identification system of judicial appraiser is one of the most active factors, as appraisal conclusion to the producer, the requirements of judicial appraiser system are particularly important. Judicial appraiser is the center of judicial authentication activities to provide scientific evidence, as the main body in lawsuit activity plays more and more important role. By reconsidering our legal analyst and comparing and analyzing the defects of the system of two large law country judicial appraiser, and to explore the differences about system from China’s specific how the actual conditions, perfect legislation, science of China to establish judicial appraiser qualification and selection method, rights, obligations and legal responsibility and basic system. This article from the practice of China’s judicial authentication, imagine that establishing a uniform, independent, science fair judicial qualification system, standardize appraiser management, strict appraiser qualification, reform appraiser selection system, to specify the rights and obligations and legal expert witnesses, which changes in our country at present responsibilities of judicial authentication dislocations, make the judicial authentication system in action towards scientific, democratic, institutional goal development.
