Abstract


As an important part of administrative procedures,the administrative law-enforcement files are the important basis of procedure justice in administrative law. China’s current legislation on the provisions of the administrative law enforcement files system is not perfect, and the theoretical study is also in the initial stage. In practice the content of administrative law-enforcement files is confused and the production is simple and its effect has no unified criterion. Its function of regulating executive power and safeguarding the legitimate rights and interests of the administrative counterpart isn’t into full play. This article adopts the method of combining empirical analysis and theoretical research, starts from the current existing problems of the administrative law-enforcement files, explores the roots of the problem, And based on the introduction of foreign experiences analyzes the value of administrative law-enforcement files system,special situation of China was also considered before suggestion of perfecting China’s administrative law-enforcement files system were given. This article conducts a complete construction on the content of administrative law enforcement files, production and management regulations and its validities in the administrative law-enforcement procedures, administrative review procedures and administrative litigation.
