Abstract


Operator security obligations is the reasonable limit set by the operator of the law within the scope of the statutory obligations. "Tort liability law" for the first time in the form of legislation to establish the operator safety guarantee obligation, but only stipulated in specific circumstances and under the applicable, has been clear about the supplement responsibility, an operator failed to end all tort forms. Security obligations of operators in the other sectors of our country stipulated is very scattered, security obligations of operators in the theoretical circle has made some discussions, including the operator safety guarantee obligation of legal relation between composition and performance of the operator to consumer's security obligations should be within a certain reasonable limits, etc. In view of this, the author just clear operator security obligations should apply the principle of presumption of fault liability, the principle of presumption of fault liability burden of proof allocation and exemption for some own Suggestions are put forward.
