Abstract


As a result of escalating importance of environmental pollution, together with in-depth administrative reform, vertical management of environmental administrative system is gaining more attention. So far, environmental protection departments' dissertation">environmental protection departments in China are mostly set up according to the administrative division, led by their higher authorities together with local governments, and mainly the latter. They are also treated as a part of local governments. Under this kind of system, they are usually restricted by local governments and administrative division, and incapable of tackling with environmental problems. This paper firstly criticizes the current system, and then utilizes the research methods of history, field, literature, and comparison to explain that vertical management system stresses centralization, and can be an acceptable system for those countries that are trying to strengthen market supervision. Theoretically and actually, Chinese environmental protection departments possess enough grounds to be vertically led by their higher authorities, which will help the authorities to deal with environmental pollution. In some provinces, this vertical management system is already under test. The last part of this paper elaborates the proper vertical management system, partition of environmental administration power as well as several measures related to this system, such as environmental protection accountability, evaluation system, supervision system from local people’s congress, citizen participation and law amendments related.
