Abstract


Civil mediation as an important way in civil lawsuit mediation, the integration of factors such as emotion, order, resolve contradictions, will play an important role in maintaining social stability and economic order. Had lawyers questioned the validity of mediation, but now society in practice has fully realized the value of mediation, conciliation not do more harm than good in contributing to social development. Of mediation conceptual change in the legal profession needs efforts from the judge, lawyer, jurist, could say how the mediation to perfect is that mediation system play its proper value. Build the mediation system of court of law enforcement, the court of justice image is necessary. Mediation system in judicial practice at home and abroad as a starting point, this paper use the empirical method, the mediation of deep level defects in perspective, and analyzes the current court mediation system, on the basis of the court mediation system in China are put forward. In order to realize the due value and status in civil lawsuit mediation.
