Abstract


With the rapid development of Internet in modern society, The violation phenomena of QQ number and other virtual property is common. As a part of life of young people, QQ number theft happens occasionally especially. At present, QQ number and other virtual property is not clearly defined in Chinese laws, which results judicial confusion of stealing QQ number and other virtual property. In the judicial practice, many similar cases have different results, which are decided by different judges who have different perspectives.This paper selects the typical case "Astronomical QQ Number Theft" and analyzes the judge reason, the controversial object:QQ number, the conviction according to our country’s legal rule and comes to conclusions:QQ number is property in the sense of criminal law and this case should not constitute crime of violation of freedom of communication but crime of theft. Finally, the case raises my some thinking:Is it reasonable that avoiding disputed topics in judicial practice? Is it necessary and feasible to protect QQ number in criminal law? How to protect QQ number and other virtual property in criminal law? This paper analyzes and summarizes for the general idea of such cases with the situation of this paper and the viewpoints of scholars and judicial officers and makes some recommendations of criminal regulation.
